Who Can File?

The Personal Representative

In Oklahoma, the wrongful death lawsuit must usually be filed by the Personal Representative of the deceased person's estate. This is often the person named as "Executor" in the will. If there is no will, the court will appoint one (usually the spouse or next of kin).

Beneficiaries (Who Gets the Money?)

Even though the Personal Representative files the suit, they do so on behalf of the beneficiaries. Recovery is typically available for:

• Surviving Spouse: For loss of consortium and support.
• Children: For loss of parental guidance and grief.
• Parents: For grief and loss of companionship (even for adult children).

What About siblings?

Siblings are generally not entitled to recover for grief/loss of companionship in Oklahoma unless there is no surviving spouse, child, or parent, and they can prove dependency.
